1. Definitions and determinations
1.1 Definitions
• E-Ticket: A ticket received by e-mail after an order via www.incubate.org or one of the online ticket-outlets of Paylogic, which gives you access to the event
• Paylogic: Paylogic, legally part of the Accepté B.V., is the official and only company providing tickets for Incubate 2009
• Physical Ticket: A ticket sold at the Primera outlets and provided by Paylogic, which gives you access to the event
• Record(ing)(s): Video, Photo or any other registrations of the festival
• Service Fee: An additional amount of money added by Paylogic for the use of their service. E-tickets have a fee per order; physical tickets have a fee per ticket
• Visitor: Any person visiting the festival in any function
• Incubate, Festival or Event: Any event or performance organized by Incubate , registered as Stichting Incubate at the Chamber of Commerce in Tilburg

1.2 Determinations
• These Terms & Conditions fall under Dutch law
• Ordering a ticket or entering the event, you agree with these Terms and Conditions, deposit at the Chamber of commerce in Tilburg
• Tickets are and stay property of the event
• It's possible we change these Terms & Conditions at any time without notice

2. Tickets
2.1 General
• No refunds or exchanges will be given on any tickets for any reason except the total cancellation or postponement of the event
• Refunds will be handled by Paylogic. Fee and transaction costs will not be restituted
• The right is reserved to add, withdraw, reschedule or substitute and/or vary programs, prices, venues and audience capacity at all time without notice
• All tickets are sold online via www.incubate.org via Paylogic and the ticket outlets at Primera stores

2.2 E-tickets
• You will receive a confirmation of your booking by e-mail
• Payments will be handled via all payment methods offered by Paylogic, including Visa- and Mastercard, iDeal, banktransfersbank transfers from different countries and many more. You can see all payment methods in the payment section while ordering your tickets

2.3 Tickets via Primera outlets
• Tickets from Primera outlets are brought by Paylogic and include a unique barcodebar code which gives you access to the event

2.4 Service fee
• A service fee will be added per order or ticket during the order process
• The service fee may be subject to change or vary between different tickets or between E-tickets and physical tickets

3. Visiting the festival
3.1 Recordings
• Making records for personal use is allowed at all performances and events, unless mentioned or instructed otherwise by the event qualified personnel or notifications
• Professional recordings, e.g. records for publications and broadcasting's,broadcast, are not allowed at any time, unless the medium has written consent from the event organization
• Media must have written consent prior to the happening of the event
• All records made at the event may be used by the organization without notification. The organization will respect the owner by giving credits as good as possible

3.2 Admittance
• The organizer has the right to expel visitors from the event when others could be or are offended by symbols, appearance or behavior
• The organizer is not responsible for any damages, harm, injury or losses
• Admittance is only ensured with a valid (E-)ticket. You have to exchange this (E-)ticket for a wristband at the Incubate Info Center. Without this wristband you will not have access to the participating venues

4. Privacy Policy
• All information entered during the order-process, e.g. Address, Telephone, Birth Date, etcetera will stay in our hands. Third Parties will never get any of this info. We might use some of the information for our statistics but no personal information will be involved.
• Your submitted information will be securely stored on both Paylogic and the events servers
• Your e-mail address will be added to the events mailing list after ordering the tickets. You might not be interested in it, so you can unsubscribe via www.incubate.org or via the first newsletter you receive
• We also may use your e-mail address for urgent updates on the festival, like cancellations, change of times, etcetera

5. Disclaimer
Incubate tries to show you art (be it music, film, theater, visual or otherwise) that originates in underground scenes and (sub)cultures. The artist’s ways of dealing with life and art might not be your preferred choice.
The ideas, meanings and intentions of artists participating in the festival are not necessarily our own. We feel that it is important to highlight different aspects of cutting edge art, even though the imagery displayed or styles shown might offend others. Please be aware of that risk within the artistic choices we make as a festival.

Like our teachers told us: contradictions like positivism and negativism, sperm and blood have always been central themes in art; from The Old Testament till Dante's Inferno, from Monteverdi till Motörhead and from Jesus till GG Allin.
Parody, irony, pastiche, deconstruction, the anti-aesthetic are some of the techniques. (Anti)utopism and the quest for pure honesty and pure evil are some of the themes. The response may say as much about the recipient's mind as it says about the sender.

This does not mean that everything is possible at the festival. If we, or the majority of the audience, could be offended by symbols, appearance or behavior, we have the right to ban you from our festival.
